You do not have the right to resell a song to download. You may not have the right any longer to sell songs recorded on physical media. Modify the rights and may be revoked when new technologies emerge, but can only be changed by its creators. And we, the authors, the creators are the absolute rights of all our work. The Supreme Court and the Constitution support us fully. I think people should be thrown in jail for selling music in any of the counts. YOU do not have permission to sell any material copyright in any medium, in my humble opinion.
A downloaded song, I agree. After all, you still have that after the band. But if you have purchased a CD, tape or disk, then you have the right to resell the item. That is according to the doctrine of first sale, which transfers the property a legal copy for the buyer to resell, if desired.
